BoutiqueAI ("we," "our," or "us") provides software tools that help boutiques manage products, customers, sales insights, and WhatsApp-based marketing and customer communication. This Privacy Policy explains how we collect, use, store, share, and protect information when boutique owners, their staff, customers, or website visitors use our mobile app, website, APIs, and related services (collectively, the "Services"). By using BoutiqueAI, you agree to the collection and use of information in accordance with this Privacy Policy.

1. Information We Collect

We may collect business and account information from boutique owners and authorized users, including name, business name, mobile number, WhatsApp number, email address, shop address, city, store category, logo, subscription and wallet information, and authentication details such as OTP verification data.

We may also collect customer and operational data uploaded or entered by boutiques, such as customer names, phone numbers, purchase history, order details, sales records, campaign selections, product catalogs, pricing, preferences, and communication opt-in status.

If you connect your WhatsApp Business account through our platform, we may collect and process WhatsApp-related metadata such as business profile information, WABA identifiers, phone number identifiers, onboarding status, webhook events, delivery/read statuses, and message template usage.

We may also collect device, log, and technical usage information such as IP address, device type, operating system, browser/app version, timestamps, crash logs, diagnostics, and app interaction data to maintain security and improve performance.

2. How We Use Information

We use the information we collect to create and manage accounts, verify users, provide the Services, onboard and manage WhatsApp Business accounts, process internal wallet usage, enable campaign creation and delivery, personalize product and customer insights, maintain records, provide customer support, detect fraud or misuse, comply with legal obligations, and improve our platform.

We may also use information in aggregated or de-identified form for analytics, research, service optimization, and business reporting.

3. Boutique Responsibilities & Data Sharing

We process information on behalf of boutiques in order to deliver our Services. Boutiques are responsible for ensuring that they have appropriate rights, notices, and consent, including WhatsApp opt-ins where required by law or platform policy, before uploading customer data or sending communications using BoutiqueAI.

We do not sell personal information. We may share information with trusted service providers and infrastructure partners who help us operate the Services, such as cloud hosting, database, analytics, storage, authentication, messaging, communications, and payment support providers.

We may also share information with WhatsApp Business Platform providers, Meta, and related onboarding or messaging partners, including Gupshup and Meta, when necessary to enable WhatsApp onboarding, messaging, account verification, webhook processing, and related functionality.

We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, safety, security, and integrity of BoutiqueAI, our users, or others.

4. Data Retention

We retain information for as long as necessary to provide the Services, maintain legitimate business records, resolve disputes, enforce agreements, comply with legal obligations, and support security and fraud prevention. The retention period may vary depending on the type of data, the nature of the relationship, and applicable legal requirements.

When information is no longer needed, we will delete it, anonymize it, or securely store it in accordance with applicable law and our internal retention practices.

5. Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect personal and business information against unauthorized access, loss, misuse, alteration, or disclosure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Users are responsible for maintaining the confidentiality of their credentials and restricting unauthorized access to their accounts and devices.

6. Your Rights

Depending on your location and applicable law, you may have rights to access, update, correct, delete, or restrict the use of your personal information, or to request a copy of certain information we hold about you. Boutique owners may also request deletion of their account or associated data, subject to legal, contractual, and operational retention requirements.

If you are a customer of a boutique that uses BoutiqueAI, please note that we may process your data on behalf of that boutique, and in many cases you should direct your request to the relevant boutique first.

7. Children's Privacy

Our Services are not intended for children under the age of 18, and we do not knowingly collect personal information from children. If we become aware that we have collected information from a child without appropriate authorization, we will take reasonable steps to delete it.

8. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our Services, legal requirements, or operational practices. When we do, we will revise the Effective Date above and, where required, provide additional notice. Continued use of the Services after an update means you accept the revised Privacy Policy.
